1. AGREEMENT TO TERMS

1.1 These Terms and Conditions (the “Terms”) govern your access to and use of the Prosperity English website (www.prosperityenglish.com, the “Site”) and any services provided on or through it, including all related applications, content, technology, and tools (collectively, the “Services”).

1.2 By using the Site and Services (including, but not limited to, any access through a distributor or school account), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Site or Services.

1.3 We recommend that you print or save a copy of these Terms for your records.

1.4 These Terms refer to the following additional documents, which also apply to your use of the Site and Services:

  • Our Privacy Policy, which sets out how we handle personal data and comply with the General Data Protection Regulation (GDPR).
  • Our Acceptable Use Policy, which sets out permitted and prohibited uses of the Site.
  • Our Cookies Policy, which explains how we use cookies and similar technologies.

1.5 If you are under the age of 18 (or the age of majority in your jurisdiction), you must have the consent of a parent, guardian, or other responsible adult to use the Site and Services. By using the Site, you confirm that you meet the age requirement or have appropriate consent to do so. Schools that permit minors to use these Services must ensure they have obtained all necessary consents in accordance with local regulations.

2. OUR SERVICES

2.1 Nature of Services

Prosperity English provides AI-assisted and, in some cases, human-reviewed assessments of English writing and language tasks. Our tools and feedback are designed to help users—including schools, teachers, and students—improve their English language skills. We are not an official exam board, nor do we guarantee that using our Services will yield the same results on standardised examinations. Use of English’, ‘Cambridge B2 First’, ‘FCE’, ‘Cambridge C1 Advanced’, ‘CAE’, ‘Cambridge C2 Proficiency’ and ‘CPE’ are brands belonging to The Chancellor, Masters and Scholars of the University of Cambridge and are not associated with Prosperity English or its products.

2.2 School and Distributor Workflows

  • Distributor Invitations: Distributors may invite schools to join the platform by entering the administrator’s name, email address, and school name.
  • School Administrator Trial: A school administrator who accepts the invitation receives a trial account.
  • Teacher and Student Accounts: Once on the platform, school administrators (or teachers with administrator permissions) can add teachers and students. Only minimal data (e.g., name and email/username) is collected to create accounts.
  • Subscriptions: If the school decides to unlock all available tests or features, the distributor can apply a subscription to the school account.

2.3 AI Grading

Writing and Word Transformation Tasks: Our Services include AI-graded tasks for English language practice, such as writing tasks (B2–C2 levels) or “part 4” word transformation tasks.

Guidance Feedback: AI-generated feedback is provided at the question or task level to offer guidance. Teachers and school administrators can view all student submissions and AI feedback within their designated classes or groups.

2.4 No Official Endorsement

Our grading and feedback tools are developed independently. Achieving high scores on our Site does not guarantee similar outcomes on third-party exams or placements. We make no warranties as to how any user will perform in standardised or other external examinations.

2.5 Amendments to Services

We reserve the right to update, modify, suspend, or discontinue parts of or the entirety of the Services at any time without prior notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

3. ACCEPTABLE USE

3.1 Permitted Uses

You may use the Site and Services only for lawful and educational purposes, in accordance with these Terms and any policies referenced herein.

3.2 Prohibited Uses

You agree not to:

  • Violate any applicable law or regulation.
  • Transmit or upload viruses, malware, or other harmful code to or through the Site.
  • Harvest or collect information about other users without their explicit consent.
  • Use the Site or its content for any fraudulent, unethical, or exploitative purpose.
  • Post, upload, or share any unlawful, defamatory, or offensive content or any content that infringes another person’s intellectual property or privacy.
  • Engage in automated data collection (scraping, data mining, robots, or similar tools) without our express written permission.
  • Circumvent, disable, or otherwise interfere with security-related features of the Site.

3.3 Content Standards

Any content you submit to the Site (e.g., essays, personal notes, comments) must:

  • Be accurate (where they state facts).
  • Be genuinely held (where they state opinions).
  • Comply with applicable law.
  • Not contain or promote discrimination, hatred, or unlawful behaviour.

3.4 Consequences of Breach

Any violation of these Terms may result in immediate suspension or termination of your account and, where necessary, legal or law enforcement measures.

4. ACCOUNT REGISTRATION AND SECURITY

4.1 Account Requirements

School/Distributor Accounts: A distributor may create or invite a school administrator account. The school administrator may then create sub-accounts for teachers and students.

Information Accuracy: When registering, you must provide accurate, current, and complete information (e.g., name and email address) and keep such information updated.

4.2 Account Security

You are responsible for safeguarding the confidentiality of your password and any other login credentials. You agree not to share your credentials with any third party and to notify us immediately if you suspect any unauthorised use of your account. School administrators and teachers must ensure that login details are only shared with authorised users.

4.3 Multiple or Fake Accounts

You must not create multiple accounts to bypass usage limitations or to deceive other users or Prosperity English. Any such accounts may be suspended or terminated.

5. PRIVACY AND DATA PROTECTION

All personal data submitted or collected through our Site and Services is handled in accordance with our Privacy and Data Collection Policy. That policy explains in detail:

  • The types of personal data we collect and the lawful bases for processing.
  • Your rights regarding your personal data, including how to access, rectify, or erase it.

6. INTELLECTUAL PROPERTY

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site and Services for educational, non-commercial use. You may not reproduce, distribute, modify, or create derivative works without our express permission.

6.3 Content You Submit

By submitting any content (e.g., essay texts) to the Site, you grant Prosperity English a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, display, and analyse this content solely for the purpose of providing and improving our Services. This licence will end when you delete the content or your account, except to the extent that the content has been anonymised or aggregated.

7.1 Third-Party Services

The Site may integrate or allow you to interact with third-party tools or services (e.g., secure payment gateways). If you choose to use these third-party services, you do so at your own risk, and their terms and policies will govern your use.

9. LIMITATION OF LIABILITY

9.1 Exclusion of Certain Damages

2.1 Data Collected During School Onboarding

School Administrator Information: When a distributor invites a school to join the platform, we collect the administrator’s name, email address, and the school name. This information is necessary to set up the school’s trial account and allow the administrator to manage the school’s use of the Services.

2.2 Data Collected from Teachers and Students

Teacher Accounts: A school administrator can add teachers to the platform by providing their name and email address. We use this information to create teacher accounts, enable login, and facilitate communication about the Services.

Student Accounts: A school administrator (or teacher) can add students to the platform by providing each student’s name and email address (or username). We do not collect any additional personal information (e.g., age, date of birth, or other sensitive data) unless explicitly needed for the functioning of the Service.

2.3 Assessment Submissions and AI Grading

Assessment Content: Students may complete various AI-graded tasks, such as writing assignments or short-answer questions. These submissions (e.g., written text, answers) are processed by AI to provide grading, feedback, and analysis. In some cases, submissions may be reviewed or moderated by human markers if required.

2.4 Automatically Collected Data

Like many online services, we may automatically collect certain non-identifying information when users visit our platform:
